American Trucking Group USA, LLC (“American Trucking,” “us,” “we”) operates several websites (“Our Sites”). By using Our Sites, you agree to the terms and conditions of this Privacy Policy. It is our policy to respect your privacy regarding any information we may collect while operating Our Sites. The purpose of this Privacy Policy is to make you aware of how we collect, use, and disclose the information we gather from our users on Our Sites. This Privacy Policy applies only to information collected through Our Sites and not to information we collect offline. By using this website, you signify your assent to our Privacy Policy. If you do not agree with any term in this Privacy Policy, please do not use this site or submit any personally identifiable information.

 

Personal Information. Certain users will choose to interact with Our Sites in ways that require us to gather certain Personal Information, such as your name, date of birth, physical address, and email address, among other things. The amount and type of information that we gather depends on the nature of the interaction and is always at the discretion of the user. American Trucking only collects information we deem as necessary or appropriate to fulfill the purpose of the user’s interaction with Our Sites. American Trucking does not disclose Personal Information other than as described below. Keep in mind that each user may refuse to supply Personal Information, with the caveat that it may prevent us from providing the service requested by the user. For purposes of this Privacy Policy, “personal information” means information that can be linked to a specific individual, such as name, postal address, mobile and wired telephone numbers and e-mail address. Personal information also includes demographic information, location information (e.g., zip code, fine location information), and other information about a specific individual, once it is associated with personal information. However, personal information does NOT include information that we collect but do not associate with you and your personal.

 

Automatic Gathering of Information by Third Parties. When you visit our website, third parties can collect personally identifiable information about your online activities over time and across different websites pertaining to your visit to, or use of, our and other Websites.

Do-Not-Track Requests. As of January 1, 2014, California residents visiting our website may request that we not automatically gather and track information pertaining to their online browsing movements across the Internet. Such requests are typically made through Web browser settings that control signals or other mechanisms that provide consumers the ability to exercise choice regarding the collection of personally identifiable information about an individual consumer’s online activities over time and across third-party Websites or online services. American Trucking does currently not honor these requests/settings.

How Your Personal Information Is Used. We use your personal information to connect you with third parties who will provide you with the services that you have requested and perform functions as described to you at the time of collection. When you submit your Personal Information to us, we use that information to contact you and/or allow a third-party affiliate to contact you via email, telephone, postal mail and mobile device for a limited period even if the telephone number you submitted appears on any state and/or federal Do Not Call list, because your inquiry creates an exception to state and/or federal Do Not Call laws. We also use your Personal Information to respond to your inquiries and/or requests, or to send you important information regarding Our Sites. Additionally, this Personal Information can be used to manage your customer relationship and provide you with customer support.

Occasionally, we may send you surveys and marketing communications that we believe may be of interest to you. We use your Personal Information to personalize your experience on the Site and our other websites by presenting advertising/display content and services tailored to you. From time to time, we will also present you with advertisements tailored to you on certain third-party websites.

The use of that information may also allow you to participate in sweepstakes, contests and similar promotions and to administer these activities. Please note that some of these activities have additional rules, which could contain additional information about how we use and disclose your Personal Information, so we suggest that you read these rules carefully. 

Finally, we use your Personal Information for certain business purposes, such as data analysis, audits, developing new products, enhancing our website, improving our services, identifying usage trends, and determining and improving the effectiveness of our promotional and advertising campaigns.

How Personal Information is Disclosed. Your Personal Information may be disclosed to third parties for the purposes described in this Privacy Policy. More specifically, we disclose that information to those who provide services such as contact information verification, customer service, data analysis, IT services, marketing and promotional services, email delivery services, and other similar services in order to enable them to provide those services. If you request information from third parties so that they can provide you with information about their services, we will provide to them your contact information. We are not responsible or liable for third parties’ use of your personal information. Other times, we may provide that information to third-party sponsors of sweepstakes, contests and similar promotions. In addition, by submitting your Personal Information, you grant us consent to use this information for the purpose of providing it to potential employers and other industry-related organizations. You are further consenting to the receipt of emails, text messages and phone calls via automated dialing system from such persons or entities or their respective representatives.

Finally, we may also disclose your personal information as we believe to be necessary or appropriate: (a) under applicable law, including laws outside your country of residence; (b) to comply with legal process; (c) to respond to requests from public and government authorities including public and government authorities outside your country of residence; (d) to enforce our terms and conditions; (e) to protect our operations or those of any of our affiliates; (f) to protect our rights, privacy, safety or property, and/or that of our affiliates, you or others; and (g) to allow us to pursue available remedies or limit the damages that we may sustain.

How We Collect, Use, and Disclose Non-Personal Information. Non-Personal Information is any information that does not reveal your specific identity, like which browser you use, your language preference, and which operating system you use. We also collect demographic data, like your location and the highest level of education you have completed. Additionally, we collect Non-Personal Information through the use of cookies, pixel tags, web beacons, or other similar technologies. Our purpose in collecting this type of information is to better understand how our users use Our Sites.

IP Addresses. American Trucking collects potentially personally-identifying information like Internet Protocol (IP) addresses for users of Our Sites. American Trucking only discloses user IP addresses under the same circumstances that it uses and discloses Personal Information as described in this Privacy Policy. 

Your IP Address is identified and logged automatically in our server log files whenever a user visits Our Sites, along with the time of the visit and the page(s) that were visited. Collecting IP Addresses is standard practice on the Internet and is done automatically by many web sites. We use IP Addresses for purposes such as calculating usage levels of Our Sites, helping diagnose server problems, geographic mapping, and administering the Our Sites.

Cookies. A cookie is a string of information that a website stores on a user’s computer, and that the user’s browser provides to the website each time the user returns. We use cookies to collect information about your usage of Our Sites. If you do not wish to have cookies placed on your computers, you should set your browsers to refuse cookies. However, please note that doing so may make it more difficult to use certain features of Our Sites which may not function properly without the aid of cookies.

Third Parties. This Privacy Policy does cover, and we are not responsible for, the privacy policies or use of information of any third parties, including those with links on Our Sites. The inclusion of a link on the Site does not imply endorsement of the linked site by us or Our Sites. 

Ads appearing on any of our websites may be delivered to users by advertising partners, who may set cookies. These cookies allow the ad server to recognize your computer each time they send you an online advertisement to compile information about you or others who use your computer. This information allows ad networks to, among other things, deliver targeted advertisements that they believe will be of most interest to you. 

Our Sites may include social media features from third party social media websites. These features may collect your IP address, which page you are visiting on our site, and may set a cookie to enable the feature to function properly. These features are either hosted by a third party or hosted directly on our Site. Your interactions with these features are governed by the privacy policy of the company providing it.

Security. We use reasonable measures to protect any information we gather from our users. Unfortunately, no data transmission over the Internet or data storage system can be guaranteed to be secure. How you can access, change, or have your Personal Information removed. If you would like to review, correct, update, suppress, delete or otherwise limit our use of the information you have provided to us, you may do so by emailing us at info@americantruckinggroup.com. We will only implement such requests with respect to the information associated with the particular e-mail address that you use to send us your request, and we may need to verify your identity before implementing your request. 

In your request, please state your email address, what information you would like to have changed, and/or whether you would like to have your Personal Information removed from our records. We will try to comply with your request as soon as reasonably possible. In some cases, we may not be able to remove your Personal Information, in which case we will let you know if we are unable to do so and why.

Use of Materials. You may not download, store or output the materials on our websites. Any reproduction, transmission, performance, displays or editing of these materials by any means mechanical or electronic without our express written permission is strictly prohibited. Retention Period. We will retain your Personal Information for as long as your account is active or as needed to provide you services and for the period necessary to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required or allowed by law or as necessary to resolve disputes and enforce our agreements. Use by Minors. The Site is not directed to individuals under the age of thirteen (13), and we request that these individuals do not provide Personal Information through the Site.

Business Transfers. If American Trucking, or substantially all of its assets, were to be a part of any reorganization, merger, sale, joint venture, assignment, transfer, or any other disposition of property, or in the unlikely event that American Trucking goes out of business or enters bankruptcy, user information would be one of the assets that is passed to a third party.
